Jury trial could decide that. So far as I understood the story, he hasn't been charged yet. Which leads me to believe that either
a) powerful people tend not to be charged with crimes
b) there wasn't a substantial case to be made that he actually violated some criminal statute.
Perhaps we'll know soon enough.

True. But that's kind of what b implies.
I'm not sure this would be the most effective way to attempt a character assassination anyway. Gore is kind of the straight man in every joke about him. This makes him look a little less robotic. Which isn't exactly the best way to attack somebody.
Some people also lie about a powerful person that way they can either get a lot of money or achieve fame themselves.
That is up to the court to decide.
He also should be charged with fraud.
