No because it's a sale, regardless. As long as the original person paid the face value, it's his business whether or not he wants to sell it for a higher price, and whether the person on the other end wants to buy it for that higher price or not.
In some venues it is already illegal. I guess that is really up to the locale of the event, and what the local ordinances cover.
How is it that your appreciation for markets appears?… and disappears when the venue is something other than what you can make a buck on yourself?
The ticket represents a lease to that one game to the holder of, therefore it should be legal to transfer property to any other person. Nobody loses and it keeps games open, and finds the best market pricing.
